Chapter 7What debts can I get rid of? There are exceptions to what debts can be discharged. Any debts that are subject to a Security Interest (such as in a mortgage or auto loan) are not discharged unless you are willing to surrender the collateral for the loan. If so, then you walk away and pay nothing. Other examples of debts that are not typically discharged in a bankruptcy case are domestic support obligations such as child support or alimony, recent taxes, (some types of taxes are never dischargeable-like employee withholding taxes, etc.), most student loans, debts that are a result of willful and malicious conduct, debts incurred by fraud, etc.
